10. Cookies and similar technologies
We use cookies and similar technologies for the following categories:
- Strictly necessary cookies, which are required for core site functions, security, and basic service delivery.
- Analytics cookies, which help us understand website usage and improve performance.

Where required, we obtain consent before using non-essential cookies. Users can manage cookie preferences through our cookie settings tool and through browser controls. For users in Quebec, we aim to provide clear notice of any technology that allows identification, location, or profiling and the means to activate or deactivate those features.
Please see our Cookie Policy for more detail, including cookie categories, purposes, and retention.
11. Automated processing and profiling
We may use tools that help us evaluate website traffic, detect fraud, route inquiries, prioritize leads, or support account and operational workflows.
If we ever make a decision about an individual based exclusively on automated processing where applicable law requires notice or additional rights, we will provide the legally required information and applicable review or request mechanisms.
12. How we disclose personal information
We may disclose personal information to:
- other Setara entities involved in the relevant business activity;
- transportation providers, carriers, drayage providers, rail providers, ocean carriers, terminals, warehouses, and other logistics counterparties involved in the requested services;
- service providers that support website hosting, analytics, customer relationship management, marketing, transportation management, accounting, communications, document management, fraud prevention, carrier vetting, and credit review;
- professional advisers such as lawyers, auditors, insurers, and financial advisers;
- public authorities, regulators, customs agencies, border agencies, law enforcement, and courts where required or permitted by law; and
- buyers, investors, lenders, or other transaction participants in connection with a corporate transaction, subject to appropriate protections.
We use service-provider categories rather than naming every provider because our toolset and vendors may change over time. Examples of provider categories that may be used include CRM and marketing platforms, transportation management systems, accounting tools, carrier-vetting tools, shipper credit-checking services, email and productivity suites, website hosts, and analytics providers.
13. Cross-border transfers and international access
Personal information may be processed or stored in Canada and the United States, and may be accessible to service providers or affiliates in other jurisdictions where they support our business.
When personal information is transferred or made accessible outside Quebec or another home jurisdiction, it may be subject to the laws of the receiving jurisdiction and may be accessible to courts, regulators, or law-enforcement authorities there.
Where required, we assess cross-border processing arrangements, including whether the information will receive protection consistent with applicable legal requirements, and we use contractual and operational safeguards that are appropriate to the sensitivity of the information.

- role-based access controls;
- contractual confidentiality requirements;
- secure storage practices;
- logging and monitoring;
- cybersecurity controls;
- vendor due diligence; and
- retention and destruction procedures.
No method of transmission or storage is completely secure. We therefore cannot guarantee absolute security.
15. Retention
We retain personal information only as long as necessary for the purposes described in this Policy, to meet legal and operational requirements, and to resolve disputes or enforce agreements. When information is no longer required, we delete, anonymize, or securely destroy it, subject to backup, archival, and legal-retention constraints.

We may decline or limit a request where permitted or required by law.

Additional rights may apply if Setara later becomes subject to certain U.S. state privacy laws. We will revisit this issue as our business activities evolve.
18. Children
Our website and services are intended for business users and adults. We do not knowingly collect personal information directly from children through our website for independent use.
19. Breach handling
If a privacy or confidentiality incident occurs, we investigate, document, and respond in accordance with applicable law. Where required, we notify affected individuals and regulators and maintain records of reportable and non-reportable incidents as required by law.
